US IRA EV Tax Credit (30D) | Update

Proposed guidance issued on Foreign Entity of Concern (FEOC) rule

To qualify for tax credits, vehicles may not contain any critical minerals (from 2025) or battery components (from 2024) that were extracted, processed, or manufactured by an FEOC. In December 2023, officials used further proposed guidance on this rule. Most common interpretation: FEOC applies to all production within China and Russia, and any company that has greater than 25% ownership by the governments* of those countries. *Specifically, the government, military, and family members of senior officials.
